State below in reasonable detail why Forms 10-K, 20-F, 11-K, 10-Q, 10-D, N-CEN, N-CSR, or the transition report or portion thereof, could not be filed within the prescribed time period.

On each of March 1, 2023 and May 11, 2023, Silvergate Capital Corporation (the “Company”) filed a Form 12b-25 with the Securities and Exchange Commission (the “SEC”), disclosing that it was unable to, and does not expect to be able to, file certain reports as required under the Securities Exchange Act of 1934, as amended, for the reasons set forth therein.  For the same reasons, the Company is unable to timely file the Annual Report for the Silvergate Bank 401(k) Retirement Savings Plan on Form 11-K for the fiscal year ended December 31, 2022 (the “Form 11-K”) within the prescribed time period without unreasonable effort or expense.  The Company is working diligently to file its Form 11-K, but does not expect to be in a position to file the Form 11-K on or before the fifteenth calendar day following the due date prescribed by Rule 12b-25.
