Furthermore, the complaint alleges that Jabil, Inc., failed to provide mandatory meal and rest breaks to its employees. The class action complaint alleges, "DEFENDANT, as a matter of company policy, practice and procedure, and in violation of the applicable Labor Code, Industrial Welfare Commission ("IWC") Wage Order requirements, and the applicable provisions of California law, intentionally, knowingly, and willfully, engaged in a practice whereby DEFENDANT systematically failed to correctly calculate and record overtime compensation for overtime worked by PLAINTIFF and the other members of the CALIFORNIA CLASS, even though DEFENDANT enjoyed the benefit of this work, required employees to perform this work and permitted or suffered to permit this overtime work."

According to the class action complaint, the company's non-exempt employees were also allegedly unable to take off duty meal breaks due to their rigorous work schedules. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work. The complaint alleges that the company did not provide their employees who forfeited meal breaks additional compensation.
