The U.S. Supreme Court on Monday asked the federal government to weigh in on whether military contractors can be sued for allegedly abusing Iraqis who were detained and interrogated at the Abu Ghraib prison.

An earlier ruling by a federal appeals court in Washington, citing wartime considerations, said lawsuits against CACI International Inc. (CACI) and L-3 Communications Holdings Inc.'s (LLL) Titan unit had to be thrown out.

The Iraqi plaintiffs alleged that they or their relatives were beaten, electrocuted, raped and subjected to other kinds of abuse by private contractors working as interpreters and interrogators at Abu Ghraib.

The U.S. Solicitor General's office will respond with a brief in the case before the court reconsiders whether to accept the matter for arguments later in the 2010-2011 term.

The case is Haidar Muhsin Saleh v. Titan Corp., 09-1313.
