This Notice is being issued by the Court-appointed Notice
Administrator and was authorized by order of the United States District Court, Northern
District of California, in
Matthew Sinatro, et al. v. Barilla
America, Inc., Case No. 4:22-cv-03460-DMR.
Who is Included? You are a Class Member if you are a
California resident and purchased
Barilla brand pastas including the following product lines (Classic
Blue Box, Collezione Artisanal, Gluten Free, Veggie, and Whole
Grain) containing the Challenged Representation "Italy's #1 Brand of Pasta" (the "Products")
for personal use and not for resale during June 11, 2018 through the present (collectively
referred to as the "Class" or "Class Members"). The detailed Notice

precisely.
What is this Case About? Plaintiffs allege that:
(1) Barilla America, Inc. ("hereinafter "Barilla" or"Defendant")
owns, manufactures, and distributes Products labeled as
"Italy's #1 Brand of Pasta," which
suggests to consumers that the Products are made in Italy with Italian ingredients when in reality
the Products are manufactured in the
United States with non-Italian ingredients; (2) Class
Members lost money in the form of the price premium they paid for
Products which falsely claim to be authentic Italian pasta—that is
had they known that the Products were not made in Italy with Italian ingredients, they would not
have purchased the Products, let alone paid a "premium" for such a
valued benefit. Plaintiffs seek restitutionary, actual, statutory,
compensatory, and punitive damages, as well as reasonable
attorneys' fees and costs. Barilla denies the allegations in this
case and that prayer for relief should be granted.
What are Your Options? To stay in this litigation, do nothing,
to keep the possibility of getting money or benefits that may come
from the lawsuit. But, you give up your right to sue Barilla
separately about the same legal claims in this lawsuit, and you
will be bound by the Court's decisions and by the final judgment,
whether it is favorable or not.
To exclude yourself, you must deliver your personally signed
Opt-Out request postmarked by August 18,
2025, via first-class mail to the Class Administrator, P.O.
Box 54668, Irvine, CA 92619 or by
email to claims@apexclassaction.com. The request for exclusion must
meet the following criteria: (a) state the name, current address,
telephone number, and email address of the person requesting
exclusion; (b) express clear and unambiguous request to be excluded
from this action: "I request exclusion from the Class in Sinatro,
et al. v. Barilla America, Inc., Case No. 4:22-cv-03460-DMR (N.D.
Cal.)"; (c) contain the personal signature of the class member
seeking to be excluded (a lawyer's signature is not permitted); (d)
be individualized: seek request to be excluded only on behalf of
the Settlement Class Member and not someone else/others, unless the
class member is a minor, and a request needs to be signed by a
parent of a minor. The request for exclusion shall not be effective
unless it provides the required information and is made by August
18, 2025. By excluding yourself from this lawsuit, you will not get
any benefits from the lawsuit, but you will keep your right to sue
Barilla in a separate lawsuit for these claims with a different
lawyer. A judgment in the lawsuit, whether favorable or not, will
bind all Class Members who do not request exclusion. If you do not
request exclusion, you may enter an appearance through your own
attorney.
