Qarbon to Pursue Patent Infringement Lawsuit Against eHelp Despite Pending Acquisition by Macromedia SAN JOSE, Calif., Oct. 28 /PRNewswire/ --, Inc. a leading developer of Viewlet(R) technology for creating online animated presentations based in downtown San Jose, today announced that it plans to proceed with its lawsuit filed in Federal Court against eHelp Corporation for infringement of Qarbon's patent for fundamental technology that makes animated Web-based presentations possible. Macromedia announced plans to acquire the San Diego-based company on Wednesday. Qarbon is represented in the suit by the law firm of Carpenter & Kulas LLP, Palo Alto, Calif. The lawsuit, which was filed on September 23, 2003, charges that eHelp infringes upon United States Patent 6,404,441 B1. Qarbon holds exclusive rights to the patent which was granted by the U.S. Patent and Trademark Office on June 11, 2002. The suit asks the court for both unspecified damages for the infringing activity and for an injunction to force eHelp to cease all future infringement, including manufacturing, use and sale of infringing products. "We believe this suit is necessary to deter eHelp from competing unfairly with us by infringing on our patent with their products," said Patrick LeGranche, chairman and CEO of Qarbon. "We will continue to pursue damages for all past, present and future infringements against our intellectual property."
