Those are just minor legal points. Obviously there will be no hearing of BPRGs damages claim until after the appeal, because a) until the final verdict is completely decided, there is no point in discussing damages, & b) the longer it drags on for, the higher the damages will be. ie, discussing them today is pointless, because tomorrow they will be not be sufficeint.
SEo haven't got a leg to stand on (IMHO of course), & are just dragging it on to buy more time before the inevitable. If during that time GS or anything else had matured to fruitition, then maybe they would have had a chance of surviving, but with still no contracts, no income, losing money, & CC decision against them & costs to pay, they're stuffed.
Lets also remember that to award damages the judge needs to decide how much its all worth. BPRG might submit a claim for £xmillion, which might be considered to be way too high, but SEO have undoubtedly provided the perfect tool to calculate it from by over hyping the potential for the product.
