you seem to completely ignore the point that the MMs DID get it wrong!..you talk about the d4e being a certainty and hence the logical position of the mms in KNOWING it would happen and therefore their trading of the as yet unissued shares being ok...and yet it DIDNT HAPPEN!!!!!!!!...so how or why you keep referring to it as a certainty is beyond me...it smacks of the sort of person who can only see a situation from one side...and perhaps it is this blindness to the obvious which persuades people that your agenda is aligned with the MMs than that of an impartial interested observer?
additionally (and i dont know who it was said it) investors were accused of not doing research and following blindly...well i would imagine i am no more switched on than anyone else and i know i DID do my research and initially turned down investing in RSV and posted as such on one of the BBs coz of the d4e...however, i then came back to it a week or so later when it became obvious that the MMs were short and there WERE enough unknowns and variables to make it worth the investment risk (for a small amount in my case) that the d4e MIGHT get withdrawn in favour of alternative solutions and that the MMs would then be forced to buy stock in at a premium. This struck me then as a decent up v down risk and had the MMs actually been forced to buy stock in and settle then an EGM COULD have been called and different dilutions considered no doubt. So i cant see why the MMs side of the equation has anything to gripe about...they got it wrong so should take the medicine..jsut as the private investor has to if they get it wrong
