You overlook some important facts.It was obvious from the start that no EXPERIENCED person/organisation was going to take on the role of recovering funds for shareholders unless they received a fee based on a percentage of funds recovered.I think we all agree that DB has a significant incentive to succeed.However he has no responsibility to the RA members and has no legal obligation to listen to them.No Judge would force him to listen to a group of small shareholders who sought to put themselves above the interests of the main body of shareholders.In a democracy the majority rules.The RA members are now a tiny minority who have decided to go their own way.That is their choice.It is appropriate for DB to regard these shareholders as "hostile", especially as they will not contribute anything toward the recovery of assets - this will come out of the pockets of the SOA.Yes the RA will pay fees but only for claiming funds against or suing LGB.
