Anomlous,
Theres quite a lot of info in yur good post 38620 above and I must admit I dont fully understand it all. Would it be possible to add a letter template to your great list of docs on theaction group site that, if I were to write to my broker about recovering my share certs, would instruct him what info he should give me if he cant get them from CREST..... that would be really helpful.

have you a website link or do I need to phone?.......'you may be able to check with the LSE if your transaction is on the CREST list of uncompleted settlements. CREST produces a list of these transactions each month and it is used to monitor the success of the clearance procedure'
I've generated a page on the website to take you through the procedure to verify if you've been shorted. It'll be ready tomorrow with the instructions. Follow the steps one by one and then if you are certain, there will be a couple steps, such as contacting the FSA, notifying the FOS and then writing to the Broker and MM (if you know who they are).
If they refuse to cooperate, it is up to you if you wish to go ahead with a legal action, but it might be easier to let the FOS remind them of the legal position and the fact that the Room Service Shareholders Action Group, established the absolute obligation to ensure complete settlement by contractual settlement date.
For the moment we still need to check when the Bermudan Authorities froze the ISIN numbers and stopped registrations. This is the only intervening act they could claim caused frustration - UNLESS the freezing happened after the settlement date. Then the MM is in breach and vulnerable.
