DEKATE

Celtic is right in that I am not in the slightest bit interested in who got what, but as soon as I am allowed to I will post the details, item by item - cheque by cheque, here and elsewhere as promised when I came on board.

What I am interested in is arguing before the High Court that the excess monies paid to the KPMG administrators should properly be paid to Think in which you are all now shareholders - none of you have any equity interest in the old JUST/Newscreen company, Think is the only equity holder in that.

In order for the court to direct to whom the money should be paid, KPMG say they are giving the court a blow by blow history of the cock-ups including the fact that so much money had to be repaid to some shareholders (the lucky ones!) whose paperwork didn't match up - not least because cheques were detached from applications before data bases were created, and then they couldn't be matched because some had sent in cheques from 3rd parties (grannies etc). More than £50,000 had to be repaid due to the appalling management of the share issue, and it has cost more than that again to process the refunds and deny liability to those who claim they are still due monies!

Allied to the negligence and gross incompetence of those organising the share issue, was the problem of the representations on things such as the Andersen claim and value of BUM and Jellies receivables.

But the priority at this moment is to persuade the court that KPMG are completely wrong in suggesting that the court should consider firstly whether any monies should be paid to, or put aside for, any persons who are still due a refund. That argument is being put forward because KPMG say they don't know where the money they were paid actually came from! How bizarre is that! I, and the liquidator of JUST?Nescreen, have commonality in our argument that the money was paid by the company and not from JAG or other funds, and this has already been confirmed by Mishcon de Raya - but even so that is not enough for KPMG, although God alone knows why.

So I, yes me and me alone, have to place the evidence of the glorious Chris Jones et al cock-up before the court. So what I need is a list of who to talk to and subpoena for a witness statement, and whilst Chris Jones has volunteered to provide such a statement I do not want to be reliant on what will almost certainly be a self serving CYA document - I and the Court need the truth, the WHOLE TRUTH AND NOTHING BUT THE TRUTH.

So please will people get in touch with those they knew who were involved in the rescue bid and ask them to give me names and addresses for witness statement requests. If you have names, email and other addresses please send them to me at the company email thinkplc@aol.com and I can write and ask them to help voluntarily.

I need the complete list because it does not exist in the records that I have, and there will have been many helpers who can confirm the stupid separation of cheques and mismatch of applications with the correct forms. There will be no come back on anyone - not even Chris Jones - by the court, because the court is only being asked to decide who gets the surplus KPMG monies, not rule on negligence and incompetence.
