In substance this is a patent entitlement dispute and an action for breach of confidence. The Defendant, BioProgress Technology Limited ("BioProgress") claims that it is entitled to the ownership or joint ownership of three families of patents or patent applications which are presently in the name of the Claimant, Stanelco Fibre Optics Limited ("Stanelco"). BioProgress also claims damages against Stanelco for breach of confidence. The reason that the principal claims are made by the Defendant rather than the Claimant is that the action was started by Stanelco for declaratory relief and BioProgress counterclaimed. As BioProgress shoulders the burden of proof on almost everything, the parties agreed that it should open the case.
