BOC losses US appeal against Parkinson link ruling
LONDON (AFX) - Industrial gas giant BOC Group PLC has lost an appeal to
overturn a court ruling that said there was a causal link between welding fumes
and Parkinson's disease.
The ruling by an Illinois court in 2003 awarded 1 mln usd to Parkinson's
sufferer Larry Elam who claimed inhaling welding fumes gave him Parkinson's
disease. BOC subsidiary, BOC Group Inc, was one of the three defendants.
BOC said it faced 8,500 litigation claims from people with Parkinson's as of
the end of September.
BOC said it was "disappointed" with the latest appeal court decision, adding
that it intended to appeal against the decision to the Illinois Supreme Court.
"The decision does not change The BOC Group Inc's position with respect to
the Elam case or the manganese litigation generally and the defendants will
continue to defend themselves vigorously against what they believe to be
meritless claims," the company said in a statement.
