Sorry to butt into your well informed discussion, but to the lay man in the street the SEO management have huffed and puffed their market cap up from 40 to 300 million in the space of 18 months. If they need to raise funds now it will be a lot easier than when their market cap was so relatively low. Even if the court case costs them 30 million, that in reality is only 10% of their market cap. Having said that if they had to pay out 30million it would likely more than halve their share price, but they would still be in business. Had they had to pay out a sum of 15 million 18 months ago it would have finished them.Ignoring the legal arguments surrounding the case their behaviour throughout has been shocking, and I hope that the new management of BPRG do acheive an OOC settlement prior to January the 16th.
