That is an interesting point. Would RT refuse a resonable offer by SEO and deliberately take it all the way? As you are no doubt aware, predicting the way a judgement will go always has a certain risk, even if you think you will win. If SEO cave in, so to speak, and give ownership of the Patents to BPRG, what commercial advantage does BPRG get that doesn't involve risk. The award of damages is still to be determined by the court. We don't know the strength of the argument for the (also unknown) amount asked, so we cannot assess the likelyhood of the outcome. That is RT's call.
Also, there is still the possibility of an out of court settlement being tied up with a deal which includes Cardinal.
