talha: the cc is with seo. bprg have already won but there are a set of appeals that will be heard in jan (believed to start 16th jan).
the cc is only relevant to one of bprg technologies (essentially case is that seo stole/misused ip and confidential information). the technology in question isn't priced into bprg's sp at the moment and is effectively on hold (as far as we know). bprg are also insured for their costs.
there is little downside for bprg because costs are insured and nothing is in the sp. however, upside is that another technology is suddenly ready for commercialisation, damages payable to bprg could be very substantial, we get a set of patents.
the problem for seo is that they do not have insurance. no contingent liability is factored into their sp and even if they did win (which is widely regarded as highly unlikely) all that happens is that both companies can use the dispute technology.
