It sounds possible. But what are the terms of these "mortgages"? For example, they might not, in theory, become payable for 100-years, which would be of little concern to the average investor!
It MIGHT be Ken Brooks & his associates simply trying to HELP the company with short-term cashflow problems rather than turn to the market [although that sounds a little naive!].

That the same old names repeatedly crop-up should come as no surprise - these people know each other, work together, network with each other. It always looks suspicious when presented in such a way, but...

But when the names of Simon Cawkwell & LDRCVM once again start turning-up together... well, I imagine a cynic might wonder if there is not an organised & concerted attempt to drive this company [or, at least, the shareprice] into the ground/grave.

Regarding LDRCVM's admiration of 'Lone Dolphins' post on MW's site, the "worthless" process known as PIM seems to have been sufficiently interesting for companies such as Bovis Lend Lease and Land Securities to pay significantly more than £50 to assess. Lone Dolphins might want to give them a call to explain what suckers they have been? Or just pop-in to the EcoBuild 2007 Exhibition in April to expose 3DM in public...

So, where are we now? Smoke & mirrors, from BOTH sides. There is so much insinuation of wrong-doing, but no body seems willing/able to explain in clear terms what crime 3DM/Ken Brooks has committed. Is any one here brave enough to make a specific accusation? For example, securing TWO mortgages on the same IP sounds strange to me, but as I am not an expert I am in no position to accuse.
