EPI finally loses its remaining appeal...!!
Following the decisions in favour of Symphony by the High Court in December 2004, the Court of Appeal has now, on 19th December 2005, dismissed EPI’s appeal and refused leave to appeal to the House of Lords. The written judgement of the Court will follow in due course.
Where does this leave Symphony?
For nearly two years this case has been behind many real difficulties we have had to face as a result of concerns, doubts, and delays which it has caused. Despite our absolute confidence in the eventual outcome we had to wait patiently and quietly for the decision of the Courts to convince others. We are well aware that in the interim EPI have sought very actively to spread doubt in the marketplace about Symphony and the likely outcome of this case for their own commercial advantage. On top of this, we have been obliged to divert a significant part of our valuable resources – particularly cash and management time – to this case rather than focus on the many opportunities facing us. All this is at last behind us!!!
Our technology is independent of EPI’s and we are free to exploit and develop it in any way we choose.
For our part we intend to get back all we have been denied over the last two years. We hope that those who were awaiting the final outcome of this case will at last be totally reassured by the decision of the court. As important, we hope those who were influenced by EPI’s comments will reflect on what they were told and will now be really positive at the opportunity to work with us.
Where does this leave EPI?
The first problem for EPI is to come up with some sort of ‘spin’ to explain what they have been so confidently saying about their prospects in this case, about Symphony, and every bit as difficult, what they have been saying about the uniqueness of their technology. Second, EPI are now faced with the probability of having to pay significant costs – by our estimate something over $3 million. In any event, who is now likely to believe anything they might choose to claim at this stage? Having brought these difficulties on themselves we find it hard to feel any sympathy....
