It is possible that the judges can give a fairly clear indication during the case that they either support or do not support a particular argument, but you have to be there to hear this and even then it is not too good an idea to rely on it. For example, EPI may attack the initial judgment on three fronts and the Appeal Court judges may take them apart on two of those three, but still allow them to win on the third. It really is impossible to say.
