It is normal for a claimant or defendant of limited means to have to pay money into court as security for any damages that may be awarded. I understand this to be the case here. If SYM are successful, they will obviously receive this money back. The 75% figure is simply a realistic figure that I have seen many times in commercial cases of this nature. I did not say that the Appeal Court would overturn the original decision, but I do not think it is as much of a certainty as others seem to believe. There is a case being argued here and if one side has a very weak case it is unusual for the case to extend into three days when it was not orginally listed for taking that long. They may of course receive indemnity damages and get everything back, but that is by no means certain.
