critical care monitoring, today announced that the Patents Court in
the United Kingdom has determined
that one of Boston Scientific's patents related to outer seals for
transcatheter heart valves that was asserted against the SAPIEN 3
valve is invalid, while a second patent is valid and
infringed. Edwards will promptly request an appeal on
specific aspects of the decision, and believes that the company
will ultimately prevail. Today's decision does not affect
commercial availability of the SAPIEN 3 valve.
Boston Scientific initiated litigation that now involves
multiple patents in multiple venues, and will likely yield court
actions over an extended period of time. The company is not
changing its financial guidance.
