FORT LAUDERDALE, Fla., June 22 /PRNewswire-FirstCall/ -- The Stephan Co. (AMEX:TSC) announced today that it has sued Elizabeth Arden, Inc. in the U.S. District Court for the Southern District of New York, seeking to block further sales of Elizabeth Arden's products that infringe Stephan's federally registered INTERLUDE trademark. Stephan is a manufacturer of numerous lines of high-quality personal care products, including perfumes and fragrances, sold under its INTERLUDE trademarks since the early 1960s. Stephan's INTERLUDE products are the cornerstone of personal care products sold by Stephan's Frances Denney Division. Stephan acquired the Frances Denney line in 1993. The Frances Denney Company traces its origins back to 1897 and is considered a cosmetic and fragrance pioneer.
Elizabeth Arden, Inc. launched a new fragrance named Provocative Interlude in March 2006 and has supported the launch with national advertising, including in People and Parade magazines and the New York Times newspaper. Stephan alleges that the Provocative Interlude product infringes its trademark rights in INTERLUDE. Stephan is seeking an injunction barring Elizabeth Arden from selling the Provocative Interlude products, which are currently on sale in Macy's, Dillard's and other fine stores. Stephan's President, Frank F. Ferola, stated that The Stephan Co. instituted the suit to protect its valuable trademark rights in INTERLUDE and to prevent consumer confusion raised by Elizabeth Arden's recent introduction of Provocative Interlude.
