JERSEY CITY, N.J., March 27, 2015 /PRNewswire/ -- New Jersey City University (NJCU) will inaugurate its newly established Institute for Dispute Resolution (IDR) on Monday, March 30, 2015, 5:30 – 7:00 p.m., with a jointly sponsored special event, "Ethical Issues in Business Mediation and Navigating your Client's Concerns" at the Brennan Courthouse Courtroom of the Hon. Mary K. Costello, P.J. Cv. in Jersey City.

The continuing legal education (CLE) program is co-sponsored by the Hudson County Bar Association and Foundation, Justice Marie L. Garibaldi Inn of Court, New Jersey Hispanic Bar Association, and Judicial Arbitration and Mediation Services International (JAMS).

About 100 attorneys and former local, county, and state judges will earn two NJ/NY CLE ethics credits in an interactive program with top instructors. Topics to be covered include: party tactics, confidentiality, self-determination, informed consent, and mediation vs. lawyer "Ethics Codes" as applied. The program is fully subscribed.

Justice Helen E. Hoens, New Jersey Supreme Court (Retired), will deliver the keynote address.  Presenters will include:

NJCU School of Business Institute for Dispute Resolution

New Jersey City University (NJCU) has established the NJCU School of Business Institute for Dispute Resolution (IDR) which will promote international negotiation and mediation techniques used to manage disputes in cross border commercial, investor-state, and general conflict resolution forums.

In announcing the Institute, Dr. Bernard McSherry, interim dean of the NJCU School of Business, said, "The ongoing globalization of trade and commerce requires business managers to have the most current knowledge and training needed to manage disputes. We are fortunate to have David Weiss, an eminent practitioner in the field, as the founding director of the Institute."

NJCU Visiting Scholar David S. Weiss, Esq., will serve as Director of the Institute for Dispute Resolution (IDR). Mr. Weiss heads the Alternative Dispute Resolution Group (ADR) of Weiss & Weiss, LLC. He is a trained mediator and arbitrator for the First Judicial District (Manhattan, N.Y.) for attorney fee dispute cases. He has handled a number of cross border and domestic dispute cases in mediation before noted institutions such as JAMS, ICC and the ICDR.

He has recently published at Columbia Law School's The American Review of International Arbitration on enforcement of cross border mediation agreements. He has served as an observer for the International Mediation Institute (IMI) at The United Nations Commission on International Trade Law (UNCITRAL) for proposed mediation rules on enforcement of cross border agreements.

Mr. Weiss has lectured and written widely on the topic of cross border mediation. He also focuses his legal practice in assisting profit and non-profit clients with transitions managing multiple legacy issues from labor, management deficiencies, professional outside counsel logistics, general litigation/ADR and recovery, and government regulatory and compliance affairs.

He is a member of the ICCs Young Arbitrator Forum, The ICDR of the AAA, New Jersey State Bar Association,  the New York Bar and D.C. Bar Association, and New York County Lawyers Association. He is admitted to practice before the bars of New York, New Jersey and D.C. 

Mr. Weiss holds a B.A. from Drew University, a J.D. from New York Law School, and an advanced certificate in studies in arbitration and international comparative law from Cornell University-Universite Paris I Pantheon-Sorbonne in Paris. Prior to his private practice, Mr. Weiss worked on Wall Street as a structured finance lawyer and banker.

The IDR will apply the principals of international negotiation and mediation through applied research in those fields, and act as a Qualified Mediation Assessment Provider for the International Mediation Institute, continuing legal education (CLE) programs, and an ADR certificate program under NJCU's School of Business for qualified candidates interested in dispute resolution.

The IDR will offer symposia to promote international cross-border negotiation and mediation in the State of New Jersey, and participate in cohort programs with international business schools to promote global trade and commerce, applying negotiation and mediation modalities to manage dispute risks.

Other initiatives will include:

  • creating the first New Jersey International Dispute Resolution Center to handle cross border cases in New Jersey
  • championing legislative-based initiatives to promote New Jersey as a seat for international dispute resolution.
  • fostering relationships with stakeholders in government, NGOs and international organizations to promote Center goals in applied research and field work studies.
