LONDON (Thomson Financial) - Affymetrix Inc and Illumina Inc said in a joint
statement that they have entered into a settlement agreement to resolve their
long-running patent litigation.
Under the terms of the settlement, Illumina agreed, without admitting
liability, to make a one-time payment to Affymetrix of 90 mln usd.
The two companies, which make products used in analyzing genetic
information, said they have now agreed to dismiss with prejudice all lawsuits
and counterclaims brought against the other.
In exchange for the payment, Affymetrix, granted Illumina a perpetual
covenant not to sue for making, using or selling any of Illumina's current
products, or products or technologies developed in the next four years.
