NEW YORK (AP) - Billionaire Carl Icahn says he is seeking a court order to
require Motorola to turn over documents about its mobile devices business and
senior executives.
Icahn is filing the lawsuit in the Court of Chancery of the State of
Delaware.
Icahn plans to use the documents to investigate whether the cell-phone
maker's board "failed in their duties as directors" supervising management and
setting policy.
The investor plans to use the materials as part of his proxy battle to win
four seats on the Schaumburg, Ill.-based company's board.
Icahn is seeking board documents related to a potential spin-off of the
mobile devices business and materials related to the use of company aircraft by
senior executives.
