SAN FRANCISCO (Thomson Financial) - Forest Laboratories Inc. and Merz
Pharmaceuticals GmbH said Friday they have filed a second lawsuit in the U.S.
District Court for the District of Delaware against additional companies for
infringement of a patent related to Forest's Namenda, a drug for the treatment
of Alzheimer's symptoms.
The defendants named in the lawsuit include Dr. Reddy's Laboratories Ltd.,
Genpharm Inc., Interpharm Inc., Mylan Pharmaceuticals Inc., Ranbaxy Laboratories
Ltd, and Sun India Pharmaceutical Industries Ltd.
The patent related to Namenda expires in April 2010. Forest has applied for
an extension which would extend the patent until September 2013.
Forest and Merz were notified by several companies that they had filed
abbreviated new drug applications with Paragraph IV certifications, seeking
approval to market generic versions of Namenda.
Shares of Forest fell 2.6% to $38.76.
