ECHO, Xpresschex and Nova Change Counsel in Ongoing Litigation
With LML Patent Corp.
VANCOUVER, British Columbia, Sept. 1 /PRNewswire-FirstCall/ -- LML Patent
Corp. ("LML"), a wholly-owned subsidiary of LML Payment Systems Inc. (the
"Corporation") (NASDAQ:LMLP) has agreed, and the Court has approved, a second
extension of time for ECHO (NASDAQ:ECHO), Xpresschex and Nova to respond to LML
Patent Corp.'s patent infringement complaint. A second extension was requested
by these defendants because each of them recently changed lead counsel. Nova
Information Systems, Inc. has recently changed lead counsel and will now have
O'Melveny & Meyers LLP act as lead counsel. ECHO and Xpresschex initially
retained the law firm of Sidley Austin Brown and Wood to act as their lead
counsel. These defendants have recently changed lead counsel and will now have
Belasco, Jacobs and Townsly LLP act as lead counsel.
"ECHO, Xpresschex and Nova will have until September 17, 2004 to respond to
LML's Complaint," said LML's lead counsel, Russell E. Levine, P.C. of Chicago's
Kirkland & Ellis LLP.
"Changing counsel can't change the facts," said Patrick H. Gaines, chief
executive officer and president of LML Patent Corp. and LML Payment Systems
Inc. "The defendants need a license and the sooner they accept the terms of
the license offer that's on the table, the sooner they can get rid of all of
their lawyers," Mr. Gaines added.
