SAN FRANCISCO (Thomson Financial) - EBay Inc. on Monday hailed a court
decision in its trademark case against Tiffany & Co. as a "victory for
consumers."
According to media reports, Judge Richard J. Sullivan in New York ruled that
eBay can't be held liable for trademark infringement "based solely on their
generalized knowledge that trademark infringement might be occurring on their
Web sites." Tiffany had sued eBay over the sale of counterfeit jewelry on eBay's
sites.
"The ruling confirms that eBay acted reasonably and has adequate procedures
in place to effectively address counterfeiting," San Jose, Calif.-based eBay
said in a release. "The ruling appropriately establishes that protecting brands
and trademarks is the primary burden of rights owners."
Shares of eBay fell 2.9% to $27.21, while share of Tiffany rose 15 cents to
$37.18.
