By bidding on an item, you agree to be bound by the following terms and conditions of this agreement.

-- Neither United Airlines, Inc., its third party service provider, nor Mileage Plus Auctions is an "auctioneer" in the traditional sense.

Although we are referring to Mileage Plus Auctions as an online auction website, it is important to realize that we are not a traditional "auctioneer." Instead, our Website http://www.united.com/auctions acts as a venue to allow Mileage Plus members to bid for and acquire awards utilizing mileage bidding in an auction-style format commonly referred to as "online auctions".

-- Void where prohibited.

-- United maintains the right to obtain and verify the registered information of all users who bid on auctions and cancel any and all bids at its discretion, or end any auction early if necessary.

-- Mileage Plus Auctions is subject to the terms of the Mileage Plus program. The Mileage Plus Program, including accruals, awards and bonus miles offers, is subject to change without notice. United and Mileage Plus are registered service marks. For complete details about the Mileage Plus program, visit united.com.

Registration

-- In order to enter the auction site you will need to be a registered user on United.com and enter your Mileage Plus number.

-- You must complete a bidder's profile and provide an e-mail address prior to bidding. As a condition of bidding, you agree to receive e- mails at this e-mail address.

Bidding Rules

-- You must have enough available Mileage Plus Miles in your account at the time you place your bid, and at the time you win the bid -- All bids are final. If you choose not to accept an item successfully bid upon, you forfeit all claims to Miles redeemed for the item and United Airlines shall have the right, at its discretion, to resubmit such items for auction.

-- If a bid is placed during the last 5 minute(s) of the auction, the auction will be automatically extended for an additional 5 minute(s) from the time of the latest bid. This auction will close once all bidding activity has stopped for a period of 5 minute(s).

-- Earlier bids of the same amount win over later bids.

-- If the auction closes before your bid is completed, your bid is not eligible -- A bid is considered "completed" once you receive the bid notification email -- If your submission is interrupted and you do not get to the Thank You Confirmation Page, you must resubmit your bid.

-- If you are the validated winner of the auction, redeemable miles will be immediately deducted from your account.

-- If the highest bidder for each auction does not meet all terms and conditions, or does not have sufficient redeemable miles in the account to support the bid, United will select the next highest bidder in each auction and determine if the member meets all terms and conditions and will repeat this process until all the terms and conditions are met and a winner is determined. If a winner cannot be determined, United reserves the right to start a new auction or cancel the auction entirely. Decision of judge (United) is final.

Winning an Auction

-- Miles deducted from your account will appear as a "reward redemption" on your statement of account activities -- No cash substitution of successful bid items is permitted or allowed -- Decision of judge (United Airlines) is final.

-- If you are the winner of an auction item, you agree to comply with all additional terms and conditions that may be applicable to the item and your use of the item, including terms set forth in the item's description, restrictions set forth on event/travel tickets, and rules imposed by event sites/venues. United Airlines shall not be responsible for or liable to you in connection with any restrictions, qualifications, or other terms and conditions imposed by any third party provider of the auction items/services.

-- If you are the winner of an auction item, you agree to allow United to share your name, address, phone number and e-mail address with a third-party service provider or corporate partner in order to fulfill the package and for you to redeem the package. In some instances, these third parties will need to contact winners to verify address/contact information prior to sending out information.

-- Auction winners assume all risks of loss or injury, whether personal or property damage, arising from any use of the item or services, and United Airlines will not be held liable for any such loss, injury or personal or property damage. Notwithstanding anything herein to the contrary, and in addition to any rights or remedies afforded at law or in equity, the winner hereby releases United Airlines and its respective subsidiaries, affiliates, officers, directors, stockholders, agents, employees, licensors and third party service providers from any liability whatsoever for, and waives any and all causes of action related to, any such loss, injury or personal or property damage, whether under a theory of contract, tort (including negligence), warranty or other theory. If a minor uses any item/service related to a winning bid, each minor's parents or legal guardians further agree to indemnify, defend and hold harmless United Airlines and its subsidiaries, affiliates, officers, directors, stockholders, agents, employees, licensors and third party service providers from any claims, costs, injuries, losses, or damages described herein which may be suffered by such minor. In the case of auction packages that include access to events, should all or a primary portion of the packaged events be cancelled, upon prompt written notice to and verification of the same by United Airlines, United Airlines may re-credit all or a portion of the applicable Miles to your Mileage Plus account. No refunds will be given if there is a postponement or time change of an event due to events beyond United Airlines' or its agent's control.
