Samsung Wins Partial Victory In Patent Dispute with Apple

--Court bans sale of Galaxy Tab 7.7 in Europe after Apple request --Allows sale of amended Tab 10.1, saying design now distinct from iPad --Samsung says will take measures to ensure products remain available FRANKFURT--Samsung Electronic Co. (005930.SE) won a partial victory against rival Apple Inc. (AAPL) in a German court Tuesday after Apple sued to ban sales of two Samsung tablet computer on the grounds that they violated its patents. The higher regional court in Duesseldorf cleared the sale of Samsung's amended Galaxy Tab 10.1 inch tablet computer in the European Union, saying the new design with repositioned speakers, is sufficiently distinct from the iPad. But it banned the sale of the smaller 7.7 inch version in the EU, finding its design too close to the iPad. The case is the latest chapter in a long-running saga of patent litigation between makers of electronic devices in courts around the globe. The Duesseldorf court had earlier banned the sale of Samsung's Galaxy Tab 10.1 and also Galaxy Tab 8.9 in Germany. The decision led Samsung to amend the design of the Galaxy Tab 10.1, naming the new version 10.1N. Samsung welcomed the ruling on the 10.1N, saying it "confirms our position that the Galaxy Tab 10.1N does not infringe Apple's intellectual property and does not infringe laws against unfair competition." However, the company said it was disappointed about the court's ruling regarding the Tab 7.7. "We will continue to take all available measures, including legal action, to (...) defend against Apple's claims to ensure our products remain available to consumers throughout the European Union," Samsung said.
